Overview

Welcome to Zyraelle Beauty. The terms “we”, “us” and “our” refer to Zyraelle Beauty. We operate this online store and website, including its information, content, features, products, tools and customer services collectively referred to as the “Services”. Our store is powered by Shopify.

These Terms of Service, together with the policies linked below, explain the rights and responsibilities that apply when you access our website, create an account, place an order or otherwise use the Services.

By using the Services, you agree to these Terms of Service and acknowledge our Privacy Policy. If you do not agree, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified, including rights under the Australian Consumer Law.

Section 1 – Access and Accounts

You must be at least 18 years old to create an account or place an order independently. If you are under 18, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

You must provide information that is accurate, current and complete. You are responsible for keeping your account credentials confidential and for activity conducted through your account. Please contact us promptly if you believe your account has been accessed without permission.

You must not sell, transfer, assign or license your customer account to another person.

Section 2 – Products and Product Information

We take reasonable care to display product descriptions, ingredients, shades, images, prices and availability accurately. Screen settings, lighting and device displays may cause colours or appearance to vary from the physical product.

Product packaging, ingredients or appearance may occasionally change. Customers should read the current packaging, ingredient list, warnings and directions supplied with the product before use. If you have a known allergy or sensitivity, review the ingredients carefully and seek appropriate professional advice where necessary. Stop using a product if irritation or an adverse reaction occurs.

We may update descriptions, limit purchase quantities or discontinue products. Any change will not affect an order we have already accepted unless we contact you and offer an appropriate resolution.

Nothing in this section limits your rights where a product is faulty, unsafe, not of acceptable quality, not fit for its disclosed purpose or does not match its description under the Australian Consumer Law.

Section 3 – Orders and Acceptance

Placing an order is an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean the order has been accepted. We may verify payment, stock availability, delivery information and suspected fraud before accepting an order.

We may decline or cancel an order where reasonably necessary, including because a product is unavailable, payment cannot be authorised, delivery information is incomplete, the order appears fraudulent, a pricing or product error has occurred, or purchase limits have been exceeded.

If payment has already been taken for an order we decline or cancel, we will issue a refund to the original payment method.

Please review your products, quantities and delivery address before submitting an order. If you need to change or cancel an order, contact us as soon as possible. Changes and cancellations cannot be guaranteed after processing or dispatch has started. Further details are provided in our Returns & Refund Policy.

Products purchased through our store are intended for personal or household use and must not be purchased for unauthorised commercial resale or unlawful export.

Section 4 – Prices, Payments and Billing

All store prices are displayed in Australian dollars unless clearly stated otherwise. Standard shipping within Australia is free. The final amount payable will be shown at checkout before you submit your order.

Prices, discounts and promotions may change without notice, but changes will not affect an order already accepted. Promotions may have separate conditions. If promotional conditions conflict with these Terms, the promotional conditions will apply to that promotion.

Accepted payment methods may include Visa, Mastercard, American Express, Discover and JCB when displayed at checkout. Payment options may vary depending on the device, checkout or payment provider. Full details are available in our Payment Policy.

You confirm that you are authorised to use the payment method submitted and that your billing and contact information is accurate. Payments are processed securely through Shopify and the applicable payment provider.

Section 5 – Shipping, Delivery and Tracking

We currently ship within Australia using Australia Post. Orders are generally processed within 1–2 business days. Orders placed after the 5:00 PM AWST cut-off begin processing on the next business day.

Standard delivery is estimated at 2–6 business days after dispatch, giving an estimated total delivery time of 3–8 business days from purchase.

Delivery times are estimates and may be affected by carrier delays, weather, remote-area delivery, public holidays or events outside our reasonable control. Tracking is provided after dispatch where available. You can also use our Track Your Order page.

You are responsible for entering a complete and accurate delivery address. Contact us promptly if an address needs to be changed. We cannot guarantee an address change after dispatch.

We will provide reasonable assistance with delayed, lost or misdirected orders. Nothing in this section transfers responsibility in a way that removes any right or remedy available under the Australian Consumer Law. Full information is available in our Shipping Policy.

Section 6 – Returns, Refunds and Cancellations

Eligible change-of-mind returns may be requested within 30 days after delivery, subject to the conditions in our Returns & Refund Policy.

Approved returns are free, and we will provide a prepaid return label. Returns must be sent using the approved label and to the address shown on that label. Do not send a return to our public business address unless the label specifically directs you there.

Opened or used cosmetics are not eligible for a change-of-mind return where hygiene and safety conditions apply. This does not limit rights relating to faulty, damaged, unsafe or incorrect products.

If a product arrives damaged, faulty or incorrect, please contact us as soon as possible, preferably within two days, and provide your order number and clear photographs where available. The two-day request helps us investigate quickly but is not a strict deadline and does not limit your rights under the Australian Consumer Law.

Refunds approved after inspection are issued to the original payment method within 10 business days. Processing by your bank or card provider may require additional time.

Section 7 – Intellectual Property

The Services and their original content, including our name, branding, logos, text, graphics, photographs, videos, designs and website arrangement, are owned by or licensed to Zyraelle Beauty and are protected by applicable Australian and international intellectual-property laws.

You may access and use the Services for personal, lawful and non-commercial shopping purposes. Without prior written permission, you must not reproduce, distribute, modify, republish, sell, exploit, scrape or commercially use our content, except where applicable law permits.

Shopify’s name, branding and related intellectual property belong to Shopify. Other names, logos and trademarks appearing on the Services belong to their respective owners.

Section 8 – Optional and Third-Party Tools

We may provide access to tools or features supplied by third parties, including payment, order-tracking, live-chat, social-media or other integrations. Third-party tools may be subject to their own terms and privacy policies.

To the extent permitted by law, we are not responsible for third-party services that we do not own or control. Before using an optional third-party tool, you should review the provider’s terms and privacy practices.

We may introduce new tools, resources or features. Unless separate terms are provided, those features will form part of the Services and will be subject to these Terms.

Section 9 – Third-Party Links

The Services may contain links to websites or online services operated by third parties. We do not control or guarantee the accuracy, security, availability or practices of third-party websites.

If you choose to visit or transact with a third-party website, review its terms and privacy policy first. Questions or claims concerning a third party’s own products or services should be directed to that provider.

Nothing in this section limits any responsibility that cannot legally be excluded.

Section 10 – Relationship with Shopify

Zyraelle Beauty is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Zyraelle Beauty.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Zyraelle Beauty, including any injury, damage or loss resulting from purchased products and services.

You expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with Zyraelle Beauty.

Nothing in this section excludes or limits a right or remedy that cannot legally be excluded or limited.

Section 11 – Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because Shopify hosts the Services, Shopify also collects and processes information about your access to and use of the store. Certain information may be processed in countries outside Australia.

Section 12 – Feedback and Reviews

If you voluntarily submit a review, suggestion, photograph, comment or other feedback, you confirm that you created it or have permission to submit it and that it is accurate and lawful.

You grant Zyraelle Beauty a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish and display that feedback for operating, improving and promoting the Services. This licence does not transfer ownership of your original content to us.

Feedback must not infringe intellectual-property, privacy or other rights; contain unlawful, defamatory, abusive, obscene or misleading material; impersonate another person; or contain malware.

We may moderate or remove feedback that breaches these Terms or applicable law.

Section 13 – Errors, Inaccuracies and Availability

Occasionally the Services may contain typographical errors, outdated information or omissions relating to descriptions, prices, promotions, delivery estimates or availability. We may correct genuine errors and update information.

If a material error affects an order you submitted, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected item for a refund.

Nothing in this section permits us to avoid obligations or consumer guarantees imposed by law.

Section 14 – Prohibited Uses

You may use the Services only for lawful purposes. You must not use the Services to:

  • Break any applicable law or encourage unlawful conduct.

  • Infringe intellectual-property, privacy or other legal rights.

  • Harass, threaten, abuse, defame, discriminate against or harm another person.

  • Submit false, fraudulent or misleading information.

  • Distribute spam, unsolicited promotions, malware, viruses or harmful code.

  • Impersonate another person or misrepresent your identity.

  • Collect or track another person’s personal information without lawful authority.

  • Interfere with, bypass or test the security of the Services without permission.

  • Scrape, copy, extract, resell or exploit the Services or their content without permission.

  • Interfere with another person’s ability to use the Services.

We may take reasonable steps to block, suspend or terminate access where we reasonably believe these restrictions have been breached.

This section applies to software or services that take autonomous or semi-autonomous actions on behalf of a person or organisation, referred to as an “Agent”.

An Agent must not access or interact with the Services where we have requested that it stop or where technical measures prohibit access.

An Agent must clearly identify itself in its HTTP or HTTPS requests using an accurate user-agent string, must not conceal that it is automated, must not mimic human behaviour to bypass restrictions, and must not circumvent CAPTCHAs, access controls, robot-exclusion instructions or security measures.

We may use technical measures to limit or control automated access to the Services.

Section 16 – Suspension and Termination

We may suspend or terminate access to the Services where reasonably necessary because of a material breach of these Terms, suspected fraud, unlawful conduct, misuse, a security threat or risk to other users or the Services.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct the breach.

Termination does not affect rights or obligations that arose before termination, accepted orders, refunds already due or rights that cannot be excluded by law. Provisions intended by their nature to continue after termination will remain effective.

Section 17 – Australian Consumer Guarantees

Products supplied to consumers may come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees relating to acceptable quality, fitness for disclosed purpose and matching description.

The rights and remedies provided by these Terms and our store policies are in addition to any rights and remedies available under applicable law.

No statement in these Terms, our Shipping Policy, Returns & Refund Policy or another store policy is intended to exclude or restrict those rights.

Section 18 – Disclaimers

General website content is provided for informational and shopping purposes. Although we take reasonable care, we do not promise that every non-material part of the website will always be uninterrupted, error-free or available.

To the extent permitted by law, the Services are provided on an “as available” basis. However, this disclaimer does not apply to consumer guarantees, warranties, rights or remedies that cannot legally be excluded.

Section 19 – Limitation of Liability

Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.

To the maximum extent permitted by law, Zyraelle Beauty and its service providers will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.

Where liability may lawfully be limited, it will be limited only to the extent permitted by applicable law. This section does not limit your right to an available repair, replacement, refund, compensation or other remedy under the Australian Consumer Law.

Section 20 – Indemnity

To the extent permitted by law, you are responsible for reasonable loss or damage directly caused by your unlawful use of the Services, your material breach of these Terms or your infringement of another person’s rights.

You will not be responsible under this section to the extent that the loss was caused or contributed to by Zyraelle Beauty, Shopify or another responsible party.

Nothing in this section limits rights that cannot legally be excluded.

Section 21 – Severability

If a provision of these Terms is found to be unlawful, void or unenforceable, it will be read down to the minimum extent necessary or severed where reading it down is not possible.

The remaining provisions will continue to apply.

Section 22 – Waiver and Entire Agreement

If we do not immediately enforce a right under these Terms, that does not waive the right.

These Terms and the policies incorporated by reference form the agreement between you and Zyraelle Beauty concerning use of the Services.

They replace prior communications or proposals concerning the same subject matter, except where applicable law provides otherwise.

Section 23 – Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights or obligations as part of a genuine business sale, restructure or transfer, subject to applicable law and without reducing your existing consumer rights.

Section 24 – Governing Law and Disputes

These Terms are governed by the laws of Western Australia and the applicable laws of Australia. The courts and tribunals with jurisdiction in Western Australia may hear disputes relating to these Terms.

This section does not prevent you from exercising rights or using dispute-resolution options available under the Australian Consumer Law or other applicable consumer-protection laws.

Before starting formal proceedings, you are encouraged to contact us so we can attempt to resolve the matter. This does not require you to give up or delay any urgent or non-excludable legal right.

Section 25 – Changes to These Terms

We may update these Terms to reflect changes to our Services, practices or legal obligations. The current version will be published on this page with an updated date.

Where required by law, we will provide notice of a material change. Changes will not retrospectively remove rights connected with an order already accepted unless the law permits and you agree.
